Terms of Use

Overview
These Terms of Use (the “Terms”) are an agreement between you and BxaGlobal Insurance Services, Inc., doing business as Beni Global, and its affiliates (together, “BxaGlobal,” “Beni Global,” “we,” “us,” or “our”). Beni Global is an employee benefits consulting and insurance brokerage firm based in Lake Forest, California.
These Terms govern your access to and use of beniglobal.com and its subdomains, the Beni Global client portal, document links we share from the portal, and the content, features, and functionality offered through them (together, the “Site”).
Please read these Terms and our Privacy Policy before you use the Site. By accessing or using the Site, you accept and agree to be bound by these Terms and the Privacy Policy. If you do not agree, you must not access or use the Site.
These Terms cover the Site only. The consulting, brokerage, and related professional services we perform for clients are governed by separate written agreements, such as engagement letters, broker-of-record authorizations, services agreements, and, where applicable, business associate agreements. If these Terms conflict with a signed client agreement, the client agreement controls for the services it covers.

Using the Site
Who the Site is for
The Site is intended for business use by employers, their human resources, finance, and leadership teams, their advisors, and the users those companies designate to use the client portal. You must be at least 18 years old to use the Site. The Site is not directed to children under 13. By using the Site, you represent that you meet these requirements and will comply with these Terms and all applicable laws. If you use the Site on behalf of a company, you represent that you have authority to bind that company to these Terms.
Availability
We work to keep the Site and portal available, but we do not guarantee uninterrupted or error-free access. We may suspend, withdraw, or restrict all or part of the Site at any time, for example for maintenance, security, or a change in our services, with or without notice. You are responsible for your own internet access and for making sure anyone who uses the Site through your connection or account understands these Terms.
Use outside the United States
Beni Global operates the Site from the United States, and the Site is intended for companies and individuals located in the United States. We make no representation that the Site or its content is appropriate or available in other locations. If you access the Site from outside the United States, you do so on your own initiative, you are responsible for compliance with local law, and your information will be transferred to and processed in the United States as described in our Privacy Policy.
What you may do
- Browse the Site and allow your browser to store temporary copies or cached files needed to display it.
- Print or download a reasonable number of pages for your own personal or internal business use, keeping copyright and other notices intact.
- Share links to press releases in our newsroom and quote brief excerpts from them with attribution to Beni Global.
- Link to our home page in a way that is fair and lawful and does not suggest sponsorship or endorsement where none exists.
- If you are a portal user, download documents from your company’s portal and share them with your employees and advisors as needed to administer your benefits program.
What you may not do
Except as expressly allowed in these Terms, you may not:
- Copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use Site materials for commercial purposes without our prior written permission.
- Remove or alter copyright, trademark, or other proprietary notices, or use photographs, illustrations, video, or graphics separately from their accompanying text.
- Frame or mirror the Site, or link to portal pages or other non-public pages without our permission.
- Use robots, scrapers, or other automated means to access the Site or portal, other than ordinary search-engine indexing of public pages.
- Access, or attempt to access, plans, documents, users, or other information belonging to a company other than the client account or accounts you have been assigned.
- Attempt to gain unauthorized access to the Site, any account, or any related server, network, database, or integration, or circumvent access controls, one-time sign-in codes, or other security measures.
- Decompile, reverse engineer, or otherwise attempt to extract the source code of the portal.
- Introduce viruses, malware, or other harmful material, or interfere with another person’s use of the Site.
- Use the Site to send unsolicited advertising, spam, or chain communications, or to harass, defame, or harm any person.
- Impersonate Beni Global, our staff, an insurance carrier, or any other person or entity, or misrepresent your affiliation with us or with a client.
- Use the Site in any way that violates applicable law, including laws on data protection, insurance, export controls, or unauthorized access to computer systems.
If you use any part of the Site in breach of these Terms, your right to use the Site ends immediately, and you must, at our option, return or destroy any copies of materials you have made.
Intellectual Property
The Site, the client portal, and all content, features, and functionality on them, including text, graphics, logos, icons, images, video, audio, software, and the design and arrangement of those materials, are owned by BxaGlobal, its licensors, or other providers and are protected by United States and international copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.
“Beni Global,” “Beni,” “BxaGlobal,” our logos, and other names, marks, and trade dress on the Site are trademarks or service marks of BxaGlobal or their respective owners. Nothing on the Site grants you a license to use those marks without our prior written permission or the permission of the owner. Members of the news media may reproduce the text of press releases in our newsroom and use our name and logo in coverage of them, provided the materials are not altered or used to suggest an endorsement.
Documents made available to you through the portal by insurance carriers, benefits administrators, or your own company remain the property of their respective owners and are provided to you for use in administering your benefits program.
We do not warrant that your use of materials on the Site will not infringe the rights of third parties who are not affiliated with us.
Client Portal Accounts
Invitation only
Access to the client portal is by invitation. Beni Global staff, and for some companies a designated client administrator, invite users, assign each user to a client account, and determine which documents and information that user can see. You may use the portal only for the company and purposes for which your access was granted.
Signing in
Portal users sign in with a password and a one-time code sent to the email address on the account. You must keep your password and one-time codes confidential, must not share your account, and must notify us promptly at info@beniglobal.com if you believe your account, password, or a one-time code has been compromised. Beni Global will never ask you for your password by email or telephone.
Your responsibilities
- Provide accurate information when your account is created and keep it current.
- Take responsibility for all activity under your account, including activity by anyone you allow to use it.
- If you are a client administrator, keep your company’s user list current and remove access promptly when someone leaves your company or changes roles. You are responsible for the users you invite.
- Use documents and information in the portal only to administer your company’s benefits program and in compliance with your company’s obligations to its employees, including under HIPAA and other privacy laws where they apply.
Activity records
We record sign-in and activity events in the portal, such as sign-ins, password changes, pages visited, and documents viewed, as described in our Privacy Policy. We use these records to secure accounts, investigate suspected misuse, and understand how the portal is used.
Suspension and closure
We may suspend or close an account, or restrict portal access, if we believe these Terms have been violated, if a client asks us to remove a user, if we are required to do so by law, or if we discontinue a feature. When our engagement with a client ends, we may close that client’s portal and its user accounts. Closing portal access does not, by itself, end a separate client services agreement, and records we are required to keep are retained as described in the Privacy Policy.
Portal Content and Documents
The client portal presents information and documents about your company’s benefits program that we compile from insurance carriers, benefits administration platforms, agency management systems, and your company. Some of it is prepared with software-assisted extraction and review of those documents, including artificial intelligence tools, as described in our Privacy Policy. It is provided for convenience and may contain errors or omissions, or be out of date, for example when a carrier changes rates, eligibility rules, or plan terms after we receive its documents.
The insurance policy, certificate, summary plan description, plan document, and the carrier’s or administrator’s own records control over anything shown in the portal. Renewal dates and milestones in the portal are reminders, not carrier or regulatory deadlines. Premium, contribution, and enrollment figures in the portal are not invoices, and nothing in the portal is a confirmation that a person is enrolled or that coverage is in force.
Please verify portal information against the official documents before relying on it for enrollment, payroll, compliance filings, or employee communications, and tell your Beni service team about any discrepancy so we can correct it.
Public document links
Some documents can be opened through public links that do not require a portal sign-in, so that they can be included in enrollment sites and emails. Those links are provided for your company’s benefits communications. We may revoke a link at any time, and a revoked link stops working immediately.
No Offer of Insurance and No Professional Advice
The Site describes Beni Global and supports communication with existing and prospective clients. It is not an offer to sell insurance, a solicitation to buy insurance, or an offer to contract in any jurisdiction. Products and services are available only where we are licensed and appointed to offer them, and are subject to carrier underwriting and applicable law.
Nothing on the Site is a binder, quote, confirmation of coverage, or insurance policy. Requests you submit through the contact form or the portal, such as a request for a renewal analysis or a question about a plan change, are not binding on Beni Global or any carrier until confirmed in writing. Coverage, if any, is governed solely by the applicable policy forms, certificates, plan documents, and carrier rules, which control if they conflict with anything on the Site.
Submitting the contact form, emailing us, or scheduling a conversation does not make you a client of Beni Global or create a broker-client relationship. A client relationship begins only when we agree in writing, for example through a signed engagement letter or broker-of-record authorization. Until then, we have no obligation to monitor your renewal dates, coverage, or compliance deadlines.
Articles, press releases, frequently asked questions, examples, statistics, compliance calendars, and other materials on the Site are general information. They are not legal, tax, accounting, actuarial, investment, or individualized benefits advice, and they do not create an attorney-client or fiduciary relationship. Consult your own attorney, tax advisor, or benefits counsel before acting on them. Compliance materials available through the Site or portal are general information, not legal advice, and your company remains responsible for its own plan documents, notices, filings, and compliance.
Unless a signed engagement letter or services agreement with Beni Global says otherwise, we are not the plan sponsor, plan administrator, or a named fiduciary of any employee benefit plan within the meaning of ERISA or similar law. Where we agree in a signed agreement to provide compliance, fiduciary oversight, or similar services, that agreement defines our role and responsibilities.
We use reasonable care to keep information on the Site accurate as of the date it is posted, but the Site may contain errors, omissions, or material that is out of date. We have no obligation to update it, and we may correct or remove material at any time.
Third-Party Sites and Services
The Site may link to third-party websites and services, including insurance carrier portals, benefits administration and enrollment platforms, government resources, and our pages on LinkedIn and Instagram. We provide those links for convenience. We do not control third-party sites and are not responsible for their content, availability, or practices. Your use of a third-party site is at your own risk and is governed by that site’s terms and privacy notice. A link does not mean we endorse the linked site, its operator, or any product or service described there.
Our public contact form is protected by Google reCAPTCHA. Google may collect device and usage information as described in Google’s Privacy Policy and Terms of Service.
Documents and data in the portal may be stored on, or delivered from, cloud storage, document management, and integration platforms that we use to run our business. Those providers act on our behalf under contract, as described in our Privacy Policy.
Privacy and Communications
Privacy Policy
How we collect, use, and disclose personal information is described in our Privacy Policy, which is incorporated into these Terms. Information you provide so that we can quote, place, or service coverage, and information in your company’s portal, is handled as described in the Privacy Policy and in any client agreement between us. When we receive protected health information on behalf of a group health plan, we handle it under HIPAA and our business associate agreements, as the Privacy Policy describes.
Sensitive information
Please do not send Social Security numbers, dates of birth, health or claims information, employee census files, or other sensitive personal information through the public contact form or by regular email. When we need that information to quote or service coverage, your Beni service team will provide a secure way to send it. If you send sensitive information through the contact form anyway, we will handle it as described in our Privacy Policy, but we cannot guarantee the security of information sent that way.
Feedback and suggestions
Suggestions, ideas, and feedback you send us about the Site, the portal, or our services, for example a feature request or a comment about how the portal works, are voluntary. We may use them to improve our services without any obligation to you, and you agree they are not confidential unless we agree otherwise in writing. This paragraph does not apply to personal information, which is governed by the Privacy Policy, or to information you provide in connection with a quote or client engagement.
Prohibited submissions
You agree not to post or send through the Site any material that is unlawful, threatening, defamatory, obscene, or that infringes another person’s rights. We may disclose your identity to a third party who claims that material you submitted violates their intellectual property or privacy rights, and we may cooperate with law enforcement and regulators when we receive a lawful request.
Electronic communications
When you use the Site or email us, you are communicating with us electronically, and you consent to receive communications from us electronically. We send account and service email from addresses at beniglobal.com, such as noreply@beniglobal.com, including portal invitations, one-time sign-in codes, password resets, and service notices. These messages are required to operate your account, so you cannot opt out of them while you hold one. We do not currently send marketing email. If we do in the future, those messages will include a way to unsubscribe, as described in the Privacy Policy. If you receive a suspicious message that appears to come from Beni Global, do not click its links; forward it to info@beniglobal.com.
Disclaimers and Limitation of Liability
Disclaimer of warranties
Your use of the Site is at your own risk. To the fullest extent permitted by law, the Site, the client portal, and all content on them, including the portal information described above, are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or free of errors, viruses, or other harmful components, or that defects will be corrected.
You are responsible for implementing safeguards on your own systems. Any material you download or otherwise obtain through the Site is obtained at your own discretion and risk.
This section does not limit warranties or obligations we expressly undertake in a signed client agreement for professional services.
Limitation of liability
To the fullest extent permitted by law, BxaGlobal, its affiliates, and their respective directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the Site or these Terms, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims arising out of or related to the Site or these Terms will not exceed one hundred U.S. dollars (USD $100). This cap applies only to claims about the Site. Claims about consulting, brokerage, or other professional services are governed by the applicable client agreement.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
Additional Terms
Changes to these Terms
We may revise these Terms from time to time by posting an updated version on the Site and changing the date at the top of this page. Changes are effective when posted. Your continued use of the Site after we post changes is deemed acceptance of the revised Terms. You are responsible for reviewing this page periodically. If a change materially affects portal users, we may also notify them by email or by a notice in the portal.
Indemnification
You agree to defend, indemnify, and hold harmless BxaGlobal, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, material you submit, your breach of these Terms, or a claim that your use of the Site infringes a third party’s rights. We may, at our option, assume exclusive defense of any matter subject to indemnification by you. That assumption does not excuse your obligations.
Copyright complaints
If you believe material on the Site infringes your copyright, you may send a notice that includes: (1) a description of the copyrighted work; (2) the location of the material you claim is infringing; (3) your name, address, telephone number, and email address; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner; and (6) your physical or electronic signature. Send notices to info@beniglobal.com with the subject line “Copyright” or to the mailing address below, Attention: Legal.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent preempted by United States federal law. You agree that the state and federal courts located in Orange County, California, have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Site, and you consent to personal jurisdiction and venue in those courts. We may also bring a proceeding in your country or state of residence or any other appropriate forum to enforce these Terms.
General
These Terms, together with the Privacy Policy and any documents they expressly incorporate, are the entire agreement between you and us concerning the Site and supersede prior understandings on that subject. They do not modify a signed client agreement. If a court finds any provision unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign them, or subcontract our obligations, without notice. Headings are for convenience only.
The sections of these Terms on intellectual property, portal content and documents, disclaimers and limitation of liability, indemnification, and governing law, and any other provisions that by their nature should survive, remain in effect after your account is closed or you stop using the Site.
We will not be liable for any failure or delay in performing our obligations under these Terms that results from circumstances beyond our reasonable control, including outages at carriers, hosting providers, or other third parties we rely on to operate the Site.
